How to Get an ADU Permit in Massachusetts: Step-by-Step (2026)

"By right" is the most misunderstood phrase in the new Massachusetts ADU law. It doesn't mean no permits — it means no discretionary approvals. You skip the zoning board hearings and neighbor votes, but you still go through the standard building permit process, the same as any permitted construction project in Massachusetts. Here's the actual sequence.

Step 1: Feasibility (1–2 weeks)

Before designing anything, confirm what your lot supports: zoning dimensional rules (setbacks, height, lot coverage), utility locations, and — critically on septic — Title 5 capacity. This is where most ADU projects are won or lost, and it's why we do it free.

Step 2: Design & Engineering (4–8 weeks)

Stamped architectural plans, structural engineering where needed, plot plan, and energy code compliance. Detached units also need a site plan showing setbacks and utility routing.

Step 3: Building Permit (2–6 weeks)

Your application goes to the building department — not the zoning board. For a conforming ADU the review is administrative. Trades permits (electrical, plumbing, gas) are pulled by the licensed contractors doing the work.

Step 4: Construction & Inspections (3–9 months)

Foundation, rough frame, rough electrical/plumbing, insulation, and final — inspectors sign off at each stage. Timeline depends on ADU type: basement conversions land at the short end, detached cottages the long end. Our ADU type comparison has timelines for each.

Step 5: Certificate of Occupancy

The final inspection converts your project into a legal dwelling unit — the document that matters for insurance, rental, and resale.

What Towns Can Still Require

Dimensional zoning still applies, along with health regulations (septic), conservation review near wetlands, and historic district rules where applicable. What towns can't do is demand owner-occupancy, excessive parking, or design standards stricter than single-family homes.

We handle every step of this process — permits included — as part of our turnkey ADU service.
